§ 1

GENERAL PROVISIONS

  1. The administrator of the personal data collected via the online shop www.scrabme.com is Scrabme sp. z o.o. with its registered office in Gdańsk (80-855) at Wały Piastowskie 1/1508, entered in the register of entrepreneurs of the National Court Register, NIP: 5833534679, REGON: 54136950000000, hereinafter referred to as the "Administrator".

  2. Contact with the Administrator is possible via e-mail address: biuro@scrabme.com or in writing to the Administrator's registered office address.

  3. This Privacy Policy sets out the rules for the processing and protection of personal data provided by Users in connection with their use of the online shop www.scrabme.com.

  4. The controller shall take special care to protect the interests of the data subjects and, in particular, shall ensure that the data it collects are:

    • processed in accordance with the law,
    • collected for specified, legitimate purposes and not subjected to further processing incompatible with those purposes,
    • substantively correct and adequate in relation to the purposes for which they are processed,
    • kept in a form which permits the identification of data subjects for no longer than is necessary to achieve the purpose of the processing,
    • processed in a manner that ensures adequate security of personal data, including protection against unauthorised or unlawful processing and accidental loss, destruction or damage.
  5. The controller shall apply appropriate technical and organisational measures to ensure the protection of the personal data processed.

§ 2

GROUNDS FOR PROCESSING

  1. The Administrator processes the personal data of the Users of the www.scrabme.com Shop only in the case of:

    • where it is necessary for the performance of a contract to which the data subject is party or to take steps at the request of the data subject prior to entering into a contract (Article 6(1)(b) RODO),
    • where the data subject has given his or her explicit consent to the processing of his or her personal data for one or more specified purposes (Article 6(1)(a) of the RODO),
    • when the processing is necessary for the fulfilment of a legal obligation incumbent on the Administrator (Article 6(1)(c) RODO),
    • when the processing is necessary for purposes deriving from the legitimate interests pursued by the Administrator or by a third party (Article 6(1)(f) RODO).
  2. The provision of personal data by the User is voluntary, but necessary for the performance of the services provided by the Administrator through the Shop www.scrabme.com.

§ 3

TYPE OF PERSONAL DATA PROCESSED

  1. The Administrator processes the following personal data of Users:

    • name,
    • residence or delivery address,
    • e-mail address,
    • telephone number,
    • in the case of entrepreneurs: company name, TIN,
    • in case of VAT invoice: the data necessary for issuing the invoice,
    • payment and transaction data,
    • other personal data provided by the User in the process of registration, placing an order or contacting the Shop.
  2. The Administrator also processes anonymised data related to the use of the Shop (e.g. IP address, data about the device and browser used by the User, time spent on the website, products searched for) in order to keep statistics and optimise the functioning of the Shop.

§ 4

PURPOSES OF PROCESSING PERSONAL DATA

  1. The personal data of the Users of the www.scrabme.com Shop is processed for the following purposes:
    • the execution of orders and the performance of the sales contract,
    • delivery of the ordered products,
    • handling complaints and withdrawals,
    • the operation of your account in the Shop (if applicable),
    • communication with the User in connection with the provision of services,
    • issuing sales documents (invoices, receipts),
    • conducting statistical analyses,
    • the assertion of claims relating to the sales contract concluded,
    • to carry out marketing activities, including the sending of commercial information (with the User's consent),
    • to comply with legal obligations incumbent on the Administrator, in particular tax and accounting obligations,
    • to ensure the security of services and prevent abuse.

§ 5

RETENTION PERIOD OF PERSONAL DATA

  1. Users' personal data will only be kept by the Administrator for the period necessary to fulfil the specific purposes for which they were collected, in particular:

    • data related to the performance of a sales contract - for the period necessary for the performance of the contract, and thereafter for the period corresponding to the period of limitation of claims which the Administrator may raise and which may be raised against the Administrator,
    • data processed on the basis of consent - until the User withdraws consent,
    • data processed in order to comply with legal obligations - for the time necessary to fulfil these obligations (e.g. data for tax and accounting purposes - for a period of 5 years from the end of the calendar year in which the tax obligation arose),
    • data processed for marketing purposes - until the User raises an objection.
  2. At the end of the retention period, personal data will be deleted or anonymised.

§ 6

RECIPIENTS OF PERSONAL DATA

  1. The recipients of the personal data of the Users of the www.scrabme.com Shop may be:

    • entities providing the Administrator with services necessary for the performance of the contract concluded with the User, such as: IT service providers, courier and postal companies carrying out deliveries, entities providing accounting, legal, marketing services,
    • Krajowy Integrator Płatności S.A. (Tpay) - in the case of making electronic payments,
    • state authorities or other entities authorised by law, in particular when they request access to the data on the appropriate legal basis.
  2. The controller shall make the collected personal data available only in the cases indicated above and when this is necessary for the specific purpose of processing the personal data and only to the extent necessary for its fulfilment.

  3. The controller does not transfer personal data to third countries (outside the European Economic Area) or to international organisations.

§ 7

DATA SUBJECTS' RIGHTS

  1. The user has the following rights in relation to the processing of his/her personal data:

    • The right of access to your personal data,
    • The right to rectify (amend) your personal data,
    • The right to erasure of personal data (the so-called "right to be forgotten"),
    • The right to restrict the processing of personal data,
    • the right to data portability,
    • The right to object to the processing,
    • the right to withdraw consent to the processing of personal data where such consent has previously been given,
    • The right to lodge a complaint with the supervisory authority in charge of personal data protection, i.e. the President of the Office for Personal Data Protection.
  2. The exercise of the above rights can be done by indicating your requests and sending them to the e-mail address: kontakt@scrabme.com or in writing to the Administrator's registered office address.

§ 8

COOKIES AND OTHER TECHNOLOGIES

  1. The online shop www.scrabme.com uses cookies and other similar technologies in order to adapt the website to individual users' needs and for statistical and advertising purposes.

  2. Cookies are small text files sent by a website that the User visits to the User's device (computer, smartphone or any other device that the User uses to browse websites).

  3. Types of cookies used in the Shop:

    • essential cookies - cookies which are necessary for the proper functioning of the website, enabling the use of the services available on the website, e.g. authentication cookies used for services which require authentication on the website,
    • functional cookies - cookies which make it possible to remember settings selected by the User and to personalise the User's interface, e.g. with regard to the chosen language or region of origin of the User, the font size, the appearance of the website, etc,
    • analytical cookies - cookies that make it possible to collect information about the use of the website's pages,
    • advertising cookies - cookies which make it possible to provide Users with advertising content more tailored to their interests.
  4. In many cases, the web browsing software (web browser) allows cookies to be stored on the User's terminal device by default. Users can change their cookie settings in their browser settings at any time. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the web browser settings or inform about their placement on the User's device each time.

  5. Restrictions on the use of cookies may affect some of the functionality available on the Shop's websites.

§ 9

CHANGES TO THE PRIVACY POLICY

  1. The Administrator reserves the right to make changes to the Privacy Policy. Users will be informed of any changes by posting an appropriate information on the Store's website.

  2. This Privacy Policy is effective as of 12.03.2025.

§ 10

FINAL PROVISIONS

  1. In matters not covered by this Privacy Policy, the relevant provisions of Polish law shall apply, in particular:

    • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation),
    • Act of 10 May 2018 on the protection of personal data,
    • Act of 18 July 2002 on the provision of electronic services,
    • Act of 16 July 2004. Telecommunications Law.
